2. The free website programme
- Acceptance into our free website programme is at our sole discretion and is not guaranteed by submitting an application.
- A free website includes the features described on our Pricing page at the time of your application, and may vary based on your business's needs and our reasonable judgement.
- We reserve the right to decline or discontinue an application at any stage if a business does not meet our eligibility criteria, becomes unresponsive for an extended period, or requests changes outside the reasonable scope of the free programme.
- Optional paid upgrades are governed by a separate written agreement or quote, accepted by you before any paid work begins.
3. Your responsibilities
To help us build your website, you agree to provide accurate information, respond to requests for content or feedback in a reasonably timely manner, and confirm that any content, images, or trademarks you provide us are legally yours to use or you hold the necessary rights to use them.
4. Intellectual property
Once your website is delivered and live, ownership of the final design and content created specifically for your business transfers to you, excluding any underlying tools, frameworks, or reusable code components, which remain our property. We retain the right to showcase completed work in our portfolio and marketing materials unless you request otherwise in writing.
5. Hosting and ongoing service
Website design is provided free of charge. Taking your website live requires a separate once-off hosting and domain fee, as described on our Pricing page, which covers your first 12 months. After this period, continued hosting requires either renewal at the listed rate or migration to a hosting provider of your choice, which we can assist with.
6. Limitation of liability
We provide our services on an “as is” basis and make reasonable efforts to ensure quality and reliability, but we do not guarantee specific business outcomes, such as increased sales or enquiries, as a result of your website. To the fullest extent permitted by law, our liability for any claim relating to our services is limited to the amount you have paid us, if any.
7. Termination
Either party may end an in-progress free website engagement at any time by providing written notice. We reserve the right to remove or suspend a live website in cases of misuse, illegal content, or non-payment of agreed fees for paid services.
8. Governing law
These terms are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of South African courts.
9. Changes to these terms
We may update these terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
